Disclaimer and limitation of liability
MUSEO KANTAURI declines any liability for any damages that may be caused to the visiting user as a result of external actions or attacks that may alter our website and its computer coding, or that may involve hacking techniques, in such a way that, after access, codes, scripts or harmful programs are inserted into the user’s device or system, links are inserted that lead to the download of viruses onto the user’s devices or computer systems, or hacking simply intercepts the information exchanged between the website and the user, or causes data loss or unauthorized access by third parties. If you are affected by an attack and/or a security breach, we undertake to act in accordance with the legislation in force and in accordance with our Privacy Policy and Information Security Policy.
If you access our website and its services and use them free of charge, we inform you that neither the website holder, nor its DPO, if any, nor its internal staff or external professionals responsible for privacy shall be liable for any possible damage caused as a result of the free use of the website. This shall apply irrespective of the nature of the damage, including actual loss, consequential loss, business interruption, loss of profits, loss of earnings, pecuniary, moral or reputational damage, direct or indirect damage, or any other similar damage.
If you access and use paid services, liability shall be limited exclusively to that established in the general terms and conditions of contract. Unless expressly agreed between the parties, no other type of compensation shall be included, such as consequential damage, business interruption, loss of profits, loss of earnings, pecuniary, moral or reputational damage, direct or indirect damage, or any other similar damage.
Intellectual and industrial property
This website and the pages of which it is composed are the intellectual and/or industrial property of their creators or, where applicable, of their assignees and/or licenses.
The holders, licensees or assignees of the intellectual property rights retain exploitation rights over the texts, images, icons, videos, sound files, designs, plans, maps, graphics, databases, algorithms, slogans, computer code and other elements included on the website. In addition to these rights, other industrial property exploitation rights may coexist, such as protected trademarks, trade names, designations of origin, industrial designs, patents and other similar rights.
Any form of reproduction, exploitation, copying, modification, communication, alteration, decompilation or distribution of the intellectual and industrial property for economic exploitation purposes is prohibited without the express written authorization of the holders or authorized licenses. The holders of the exploitation rights reserve and assert their rights, warning that infringement of such rights may be reported and, where appropriate, legally prosecuted, and may entail custodial sentences, penalties and compensation.
If you are a consumer user with no economic interest, you may use, view, print, download and store the contents and/or the elements inserted on the website exclusively for your personal, private and non-profit use. However, if you exercise the right to make a private copy, remember that, in order not to commit an infringement of intellectual or industrial property rights, you must attribute copyright, ownership, source or origin, and authorship.
If you consider that any text, image, icon, video, sound file, design, plan, map, graphic, database, algorithm, slogan, computer code or any other element infringes a copyright or industrial property right belonging to you or to a person whom you represent, you may submit a claim to the website holder and, where applicable, to the Webmaster and the copyright agent. In your claim, you must provide: a) full identification details, including your identity — name, surname, address, city and country — together with unequivocal identifying data — card, letter, certificate, identity or citizenship document, or passport — and, if you are acting as an agent or representative, a copy of the authorization or power of attorney of the natural or legal person represented; b) identification of the work whose copyright is allegedly infringed; c) identification of the infringing material and the information necessary to locate it; d) contact information, including address, telephone number and/or email; e) a sworn statement of ownership and, where applicable, documents evidencing that you are the holder; and f) a sworn statement made in good faith stating that the material is not authorized or licensed for use. Please note that, in some countries, false sworn statements may be prosecuted as a criminal offence.
If we receive a claim for infringement of intellectual or industrial property rights, we may proceed directly to remove the material from public display, without this implying recognition of or acquiescence to the claim received. Such removal merely means that it is faster, more economical and simpler to remove non-essential material from the website than to articulate a defense of our right over said material. If the removal of the material infringes a third party’s copyright, that third party may object to the removal by providing their identification details and contact details, identification of the material removed, a good-faith statement indicating that there was an error on our part in the removal, and a statement submitting the dispute to the courts or arbitration bodies that may correspond to us.
